Terms & Conditions
The agreement that governs your use of our website, dashboard, managed trading service and investment plans.
Last updated: October 2026
1.Introduction and acceptance
1.1These Terms and Conditions ("Terms") govern your access to and use of the website at ibfxtech.com, the client dashboard at app.ibfxtech.com and every related service, tool, feature, interface and communication provided by IB Forex Technology ("Company", "we", "us" or "our").
1.2These Terms form a legally binding agreement between you ("Client", "you" or "your") and the Company. They are supplemented by our Risk Disclosure, our Privacy Policy, the specific terms of each investment plan, trading programme or product you select (the "Plan Terms"), and any other notice, rule or policy we publish on the website or the dashboard. Together these documents are the "Agreement".
1.3By registering an account, making a deposit, appointing the Company to trade on your behalf, accepting any Plan, ticking an acceptance box, or continuing to use the website or dashboard, you confirm that you have read, understood and accepted the whole Agreement, including the Risk Disclosure.
1.4If there is a conflict between documents, the Risk Disclosure always applies in full. Plan Terms prevail over these Terms only on the specific point they address and only for that Plan. This Agreement prevails over any brochure, advertisement, social media post, chat message, email or verbal statement made by any employee, agent, introducer, affiliate or other person.
1.5If you do not agree with any part of the Agreement you must not register, deposit or use our services.
2.Definitions and interpretation
2.1In this Agreement the following words have the meanings given below:
- "Account" means your registered client account on the Platform, including every balance, record and transaction history associated with it.
- "Applicable Law" means all laws, regulations, rules, directives, orders, guidance and codes of conduct that apply to the Company, to you or to the services from time to time.
- "Business Day" means a day other than a Saturday, a Sunday or a public holiday in the Company's principal place of business. Crypto and some other markets trade outside Business Days.
- "Client Funds" means money, stablecoins, cryptocurrencies and other assets that you deposit or transfer to the Company or to a payment address designated by the Company.
- "Dashboard" means the secure client area available at app.ibfxtech.com and any related web, mobile or application interface.
- "Instruments" means shares and other securities, stock and other indices, cryptocurrencies and other digital assets, foreign exchange, commodities, contracts for difference, futures, options, binary and fixed-return contracts, spot contracts and any other financial, digital or synthetic instrument or market in which the Company may trade or take exposure.
- "Managed Trading Service" means the service under which the Company trades, or arranges for Instruments to be traded, on your behalf and for your Account under the Mandate.
- "Mandate" means the authority you give the Company in section 8 to trade on your behalf.
- "Plan" means any investment plan, trading programme, package, tier or product offered through the Platform, described in the Dashboard or in the Plan Terms.
- "Platform" means the website, the Dashboard and all related software, systems and services.
- "Returns" or "ROI" means any amount calculated, projected, targeted, credited or displayed in respect of a Plan, whether expressed as a percentage, a fixed sum or in any other way, and whether described as return on investment, profit share, yield, bonus, reward or otherwise.
- "Third-Party Providers" means brokers, exchanges, liquidity providers, custodians, wallet providers, payment processors, banks, data and charting providers, hosting and software suppliers and any other third party the Company uses or relies on.
- "Trading Capital" means the part of the Client Funds allocated to a Plan or to the Managed Trading Service.
- "Withdrawal" means a request to move funds out of your Account.
2.2In this Agreement: headings are for convenience only; "including" means "including without limitation"; the singular includes the plural and the reverse; a reference to a law includes that law as amended or replaced; references to "USD" or "$" are to United States dollars unless stated otherwise; and a reference to a "day" is to a calendar day unless it says Business Day.
3.Nature of the services
3.1The Platform provides market information tools, charts, heatmaps and data feeds, access to a client Dashboard, and, where you apply for and are accepted onto it, the Managed Trading Service and one or more Plans.
3.2The Company is a technology and trading business. Unless the Company states otherwise in writing, the Company is not a bank, a deposit-taking institution, an insurer, a pension fund or a collective investment scheme, and nothing you deposit is a bank deposit. Client Funds are not covered by any deposit insurance, investor compensation or guarantee scheme in any country.
3.3The Company does not provide personal investment, legal, tax or accounting advice. Information on the Platform is general and educational. You are solely responsible for deciding whether any Plan or service is suitable for you.
3.4The Company does not represent that it holds any particular licence, registration or authorisation in any country except where it expressly says so in writing. You are responsible for satisfying yourself that using the services is lawful in your country of residence, citizenship and tax residence.
3.5The Company may add, change, suspend or withdraw any service, Plan, Instrument, market, feature or payment method at any time, with or without notice, subject to any Plan Terms that expressly provide otherwise for a Plan already running.
4.Eligibility and capacity
4.1You may open and use an Account only if all of the following are true, and you confirm them each time you use the services:
- you are an individual aged at least 18 years, or the age of majority where you live if that is higher, or a duly authorised representative of a legally existing entity;
- you have full legal capacity to enter into a binding agreement and are not subject to any guardianship, bankruptcy, insolvency or similar proceeding;
- you are acting on your own behalf and not for any undisclosed third party, unless the Company has agreed otherwise in writing;
- you are not a resident or national of, and are not located in, a country or territory in which the services or the relevant Instruments are prohibited or restricted by Applicable Law, or which the Company has designated as restricted;
- you are not on any sanctions list, and you are not owned or controlled by, or acting for, a sanctioned person;
- the funds you deposit are your own, come from a lawful source, are not borrowed from anyone who expects repayment from trading proceeds, and are money you can afford to lose entirely.
4.2The Company may refuse an application, or restrict or close an Account, for any lawful reason and is not obliged to explain its decision where the law or its compliance policies prevent it.
5.Account registration and verification
5.1You must provide complete, accurate and current information when you register and must update it promptly if it changes. Providing false, misleading or incomplete information is a material breach of this Agreement.
5.2You may hold only one Account unless the Company agrees otherwise in writing. The Company may merge, restrict or close duplicate or linked accounts and may cancel any profit, bonus or Return generated through them.
5.3Before and after opening an Account, and before any deposit, Plan activation or Withdrawal, the Company may require identity documents, proof of address, proof of source of funds and source of wealth, selfie or liveness checks, bank or wallet ownership evidence and other information. The Company may repeat these checks at any time.
5.4Until the Company has completed verification to its satisfaction it may limit, delay or refuse any deposit, trade, Return or Withdrawal. Verification may take time and the Company is not liable for delay caused by incomplete or unclear documents or by third-party checks.
5.5You consent to the Company verifying and sharing your information with identity-verification services, banks, payment processors, regulators and law enforcement agencies as permitted by Applicable Law and our Privacy Policy.
6.Account security
6.1You are solely responsible for keeping your login details, passwords, verification codes, devices, email account and any wallet keys safe and confidential. You must use a strong, unique password and enable any additional security feature we offer.
6.2You are responsible for every action taken through your Account, whether or not you authorised it, unless you notify the Company of unauthorised access immediately after discovering it and prove that you took reasonable care. The Company may act on any instruction that appears to come from your Account without further checks.
6.3The Company will never ask you for your password, a one-time code or your wallet seed phrase. The only official dashboard address is app.ibfxtech.com and the only official website is ibfxtech.com. You must treat any other site, message or person claiming to be the Company with suspicion and must tell us about it at once.
6.4You must tell us immediately if you suspect your Account, device or email has been compromised. The Company may freeze the Account while it investigates and is not liable for losses caused by your failure to protect your credentials or by phishing, malware, SIM-swap, social-engineering or similar attacks on you.
7.Deposits and funding
7.1You may deposit only through the methods and to the bank accounts, wallet addresses or payment details shown inside your Dashboard. You must check every address, network, amount and reference carefully before sending. The Company will never ask you to send funds to a personal account or to an address that does not appear in your Dashboard.
7.2Cryptocurrency transfers are irreversible. If you send the wrong asset, use the wrong network, enter a wrong or outdated address, or send an amount below a minimum, the Company may be unable to recover the funds and is not liable for the loss. The Company may, at its discretion and for a fee, attempt recovery, with no guarantee of success.
7.3Deposits are credited only when the Company has received cleared funds, after the number of network confirmations or bank clearing time the Company requires, and after any verification checks. The Company may reject, hold or return a deposit, and may charge for the return, if it suspects it is unlawful, fraudulent, from a third party, from a high-risk source or otherwise in breach of this Agreement.
7.4You are responsible for all bank, network, exchange, processor and conversion charges involved in sending funds to the Company. Amounts credited may differ from amounts sent because of fees, rate movements or conversion.
7.5The Company may set and change minimum and maximum deposit amounts, supported currencies and supported methods at any time.
7.6You must not deposit funds that belong to someone else, funds obtained by fraud, theft, corruption or any other crime, or funds you have borrowed on the expectation of repaying them from profits.
8.Managed trading mandate and discretionary authority
8.1If you select the Managed Trading Service or any Plan, you appoint the Company as your agent and give it full discretionary authority to trade, invest and deal on your behalf and for your Account's benefit in any Instruments, markets and strategies that the Company chooses, without asking you before each decision (the "Mandate").
8.2Under the Mandate the Company may, at its sole discretion and without prior notice to you: open, increase, reduce, hedge and close positions; choose the Instruments, markets, size, timing, direction and duration of trades; use leverage, margin, short selling, derivatives, copy-trading, automated systems, algorithms, bots, signals and third-party strategies; pool your Trading Capital with that of other clients or with the Company's own funds; change or combine strategies; stop trading; and move Trading Capital between brokers, exchanges, wallets and accounts.
8.3The Company may delegate any function to affiliates, employees, contractors, strategy providers, introducing brokers or other Third-Party Providers and remains responsible to you only to the extent stated in this Agreement.
8.4The Company has no duty to follow any particular strategy, to achieve any particular outcome, to match any benchmark or to tell you about individual trades. It will make information about your Account balance and activity available through the Dashboard in the form and at the intervals it decides.
8.5You may not give trading instructions during the Mandate unless the Company has agreed to that in writing. The Company may ignore or refuse instructions that conflict with the Mandate or the Plan Terms.
8.6The Mandate continues until it ends under this Agreement or the Plan Terms. Ending the Mandate or a Plan does not cancel trades already open or obligations already incurred, and the Company may keep Trading Capital invested until open positions can be closed in an orderly way, which may take time and may cost money.
8.7You acknowledge that trading performance is uncertain, that the Company's decisions may result in loss, and that you are bound by every trade the Company makes under the Mandate, including trades that lose all of the Trading Capital.
9.Plans, Returns and ROI
9.1Each Plan has its own Plan Terms, which may include a minimum deposit, a Return rate or target, a payment frequency, a lock-in or maturity period, fees, early-exit conditions and other rules. The Plan Terms in the Dashboard at the time you activate the Plan apply to that Plan, except where this Agreement or the Company later changes them as permitted below.
9.2Any Return, ROI percentage, rate, figure, projection, example, calculator result, testimonial or illustration displayed on the Platform or communicated by anyone is a target or an estimate only. It describes what the Company aims for or what happened in a particular past period. It is not a promise, forecast, guarantee or representation that you will receive that amount or any amount.
9.3Returns depend on the Company's trading and business results. They can be lower than displayed, zero or negative. The Company may reduce, vary, suspend or stop Returns for any future period, in whole or in part, if trading results, market conditions, liquidity, costs, regulatory requirements or other circumstances make that necessary in its opinion. The Company will try to reflect a change in the Dashboard but is not required to give prior notice of a change that affects future periods only.
9.4Returns are calculated by the Company using its own methodology and records, which are final and binding absent manifest error. Returns may be credited to an Account balance as a book entry. A credit shows the amount the Company has calculated and is not a representation that cash or digital assets are immediately available.
9.5Returns are not interest on a deposit and are not a loan, a debt or a fixed obligation of the Company. The Company's obligation is limited to crediting the Returns, if any, that it determines are due under the Plan Terms.
9.6Unless the Plan Terms expressly say so, the return of your original Trading Capital is not guaranteed. Even where Plan Terms state that capital will be returned at maturity, that payment remains subject to the Company's ability to pay, to trading results, to the risks in the Risk Disclosure, to the compliance and verification requirements of this Agreement and to events outside the Company's control.
9.7If a Return, bonus or credit is posted in error, calculated incorrectly, or based on a deposit that is reversed, charged back or later found to be unlawful, the Company may reverse or correct it at any time, including by deducting it from other balances or from future Returns. If you have already withdrawn the amount, you must repay it on demand.
9.8Compounding, reinvestment, early termination, lock-in periods and renewal are governed by the Plan Terms. Where a Plan has a lock-in or maturity date, you may not withdraw the Trading Capital or related Returns before that date except as the Plan Terms allow, and any early exit may be subject to penalties, loss of Returns and delay.
9.9You must not rely on any past, projected or promised Return when deciding whether to deposit or to stay invested. If a level of Return matters to your decision, do not deposit.
10.No guarantee of profit or capital
10.1Trading and investing involve a high risk of loss. The Company does not guarantee, and nobody on its behalf may guarantee, that you will make a profit, that you will avoid a loss, that you will receive any Return, or that you will get back any or all of your Trading Capital.
10.2You may lose all of the money you deposit. You may also lose more than the money in your Account where leveraged or derivative positions are held in your name or on your behalf, depending on the terms of the broker, exchange or counterparty involved.
10.3Any statement by an employee, agent, introducer, affiliate, social media influencer or other person that suggests guaranteed or risk-free returns is unauthorised, is not binding on the Company and must not be relied on. Please report it to us.
10.4Past performance, whether of the Company, of a strategy, of a market or of any other client, is not a reliable indicator of future performance.
11.Fees, charges and costs
11.1The Company may charge management fees, performance or profit-share fees, entry or exit fees, administration fees, inactivity fees, withdrawal fees, currency conversion charges, network and gas fees, payment processor fees and any other fees that are displayed in the Dashboard, in the Plan Terms or otherwise notified to you.
11.2The Company may also earn revenue from spreads, mark-ups, commissions, rebates, funding or financing differences, and gains on the difference between the Return it credits and its actual trading results. You agree that the Company is entitled to keep these amounts and that you will not receive any share of them except as the Plan Terms say.
11.3Fees and costs may be deducted from your Account balance, from Returns or from the amount of any Withdrawal. If your balance is not enough to cover them, you must pay the shortfall on demand.
11.4Where Returns shown in the Dashboard are described as gross, fees may reduce what you actually receive. You are responsible for checking the fees before you commit.
11.5The Company may change its fees by updating the Platform. A fee change applies from the date it is published unless the Plan Terms require notice for a Plan already running.
12.Withdrawals
12.1You may request a Withdrawal through the Dashboard to a bank account, wallet or other destination that is in your own name and has been verified by the Company. The Company may refuse to pay to a third party or an unverified destination.
12.2The Company may set minimum and maximum Withdrawal amounts, processing windows, limits per day or month, supported methods and fees, and may change them at any time.
12.3Withdrawals of Trading Capital and Returns are subject to any lock-in or maturity period, notice period and early-exit rules in the Plan Terms, and to the availability of liquidity after closing positions in an orderly way.
12.4Processing times shown in the Dashboard or elsewhere are estimates, not commitments. Withdrawals may be delayed or refused while the Company: completes verification, anti-money-laundering or security reviews; investigates suspected fraud, error, abuse, chargeback or unauthorised access; waits for positions to close or funds to settle; deals with bank, network or processor delay; or responds to a legal or regulatory request.
12.5The Company may pay a Withdrawal in the same currency or asset in which the deposit was made or in another one it chooses, applying its conversion rate and costs. It may require you to withdraw through the method you used to deposit.
12.6You must give correct payment details. The Company is not liable for funds sent to the details you provide, and, in the case of cryptocurrency, transfers cannot be reversed.
12.7The Company may deduct from any Withdrawal any fees, losses, taxes, amounts you owe it, and any amount credited in error. The Company may reduce or refuse Returns or profit that it determines came from a breach of this Agreement, an error, an abuse of the system, or a prohibited practice.
12.8A Withdrawal request does not guarantee a particular price, value or timing. The value of crypto and other assets may change between the request and the payment, and you bear that risk.
13.Client Funds, segregation and insolvency
13.1Unless the Company expressly confirms otherwise in writing, the Company does not represent or warrant that Client Funds are held in segregated, trust or client-money accounts. Client Funds may be held in the Company's own accounts or wallets, with Third-Party Providers, and may be pooled with funds of other clients and of the Company.
13.2You agree that the Company may use Trading Capital to trade, to provide margin or collateral, and to settle obligations arising from the Mandate. The Company is not a trustee of Client Funds and no fiduciary or trust relationship arises from this Agreement beyond what the law imposes in the circumstances and cannot be excluded.
13.3If the Company, a broker, an exchange or any other Third-Party Provider becomes insolvent or fails, you may lose some or all of your funds, you may be an unsecured creditor with no priority, and you may receive nothing or only part of what you are owed, after a long delay.
13.4The Company is not liable for the acts, omissions, insolvency, hacking, freezing or regulatory action of any Third-Party Provider, nor for the effect of those events on your funds, except where Applicable Law requires otherwise.
13.5You grant the Company a right to hold and apply the funds and assets in your Account as security for, and a right of set-off against, any amount you owe the Company under this Agreement.
14.Anti-money laundering, sanctions and compliance
14.1The Company is committed to preventing money laundering, terrorist financing, fraud, bribery and sanctions evasion. You agree to comply with all Applicable Law and to give us any information we reasonably ask for.
14.2The Company may, without notice to you and without liability: freeze or restrict an Account; delay or refuse a deposit, trade or Withdrawal; close an Account; return funds to their source; disclose information to regulators, financial intelligence units, banks, law enforcement and other authorities; and take any step it considers necessary to comply with Applicable Law or to protect itself and its clients.
14.3The Company may be legally prohibited from telling you that it has made a report or is investigating you. You agree that the Company will not be liable for failing to do so.
14.4You confirm that you are not, and are not connected with, a politically exposed person unless you have told us, and you will tell us if that changes. You must tell us about any change in your circumstances that affects the information you have given us.
14.5You must not use the Platform for any unlawful purpose, to hide the origin of funds, to evade tax, to evade sanctions, or to finance any unlawful activity.
15.Acceptable use and prohibited conduct
15.1You must not, and must not allow anyone else to:
- give false or misleading information, impersonate another person, or operate an Account for someone else without our written permission;
- open multiple or linked accounts, or collude with others, to take advantage of any promotion, bonus, Return or system feature;
- use the Platform for fraud, money laundering, market manipulation, insider dealing or any other unlawful or abusive activity;
- use automated tools, scripts, bots or scrapers on the Platform, or try to exploit pricing delays, latency, errors, bugs or system weaknesses;
- attempt to gain unauthorised access to the Platform, other accounts or our systems, introduce malware, overload or interfere with the Platform, or test its security without our written consent;
- copy, resell, republish, frame, mirror or commercially exploit any content or data of the Platform without permission;
- use VPNs, proxies or other means to hide or misrepresent your location or identity;
- harass, abuse or threaten our staff, other users or anyone else, or publish false or defamatory statements about the Company;
- advertise, promote or recruit for any other business through the Platform or through our communication channels;
- encourage or assist anyone else to do any of the above.
15.2If you breach this section the Company may take any action described in this Agreement, including freezing the Account, cancelling trades, Returns and profits, withholding funds as needed to cover losses and costs, and reporting you to the authorities.
16.Promotions, bonuses and referral programmes
16.1The Company may from time to time offer bonuses, promotions, rewards or referral programmes. Each is governed by its own rules, which the Company may change or withdraw at any time. Any bonus is a discretionary benefit and not a right.
16.2Bonuses and rewards may carry turnover, lock-in, withdrawal or eligibility conditions. They may be removed with any Returns or profit generated from them if you breach the conditions or this Agreement, or if the Company suspects abuse.
16.3If you refer other people, you must not misrepresent the Company or its services, must not promise or imply guaranteed profits or returns, must comply with advertising and securities laws in the relevant country, and must not spam. The Company may withhold or reclaim any referral reward and close accounts involved if you breach these rules.
16.4You are not an employee, agent or partner of the Company by reason of any referral. No introducer or referrer may make a statement or give a guarantee on the Company's behalf. The Company is not responsible for anything a referrer says or does.
17.Third-party services, brokers and data
17.1The Platform uses and links to services of Third-Party Providers, including market data, charts, heatmaps and calendars supplied by TradingView, cryptocurrency prices supplied by CoinGecko, and fonts, hosting, payment, brokerage and communications services. Their content and their own terms and privacy policies apply to your use of them.
17.2The Company does not control, endorse or accept responsibility for any Third-Party Provider, for the accuracy, timeliness or completeness of its data, or for any loss caused by its failure, delay, error or unavailability. Data may be delayed, inaccurate or interrupted.
17.3Links to other websites are provided for convenience only. The Company is not responsible for their content or security, and you visit them at your own risk.
17.4The Company may use brokers, exchanges and counterparties of its choice, in any country, and may change them at any time. Those parties may have their own terms, margin rules, fees, close-out rights and regulatory status, and may hold or deal with funds in ways that the Company does not control.
18.Market data, content and no advice
18.1All market data, prices, charts, news, research, calendars, commentary, ideas, statistics and other content on the Platform are provided for general information only. They are not investment, financial, legal, tax or accounting advice and are not an offer, invitation, recommendation or solicitation to buy, sell or hold any Instrument or to join any Plan.
18.2The Company does not assess whether any service or Instrument is suitable or appropriate for you. You must make your own decisions, based on your own research and your own circumstances, and take independent professional advice where appropriate.
18.3The Company does not warrant that any information is accurate, complete or up to date. Illustrations, screenshots and mock-ups of the Dashboard, including any figures shown in them, are examples only and do not show real or expected results.
19.Risk acknowledgement
19.1By using the services you confirm that you have read and understood the Risk Disclosure in full and that you accept all the risks it describes. In particular you acknowledge that:
- trading and investing in Instruments, especially leveraged, derivative, binary and crypto Instruments, carries a high risk of loss, and you may lose all of the money you deposit;
- the Managed Trading Service is discretionary, performance is uncertain, and the Company has no obligation to achieve any result;
- Returns are not guaranteed and may be reduced, delayed or not paid;
- your funds may not be segregated, insured or protected by any compensation scheme;
- you have enough income, savings and experience, or have taken independent advice, so that you can bear a total loss without damaging your financial situation;
- you have not relied on any statement, promise, guarantee or projection that is not set out in this Agreement.
20.Conflicts of interest
20.1The Company and its directors, employees, affiliates and associates may have interests that conflict with yours. They may trade for their own accounts, in the same or opposite direction as your trades; act as counterparty to your trades; earn fees, commissions, spreads and rebates from your activity or from Third-Party Providers; and manage other clients' funds under different terms and with different results.
20.2You agree that the Company may act in these ways, and that it will not be accountable to you for any resulting profit or benefit, provided it manages conflicts as required by Applicable Law and by its own internal policies.
21.Errors, system faults and manifest errors
21.1The Platform depends on technology that can fail. The Company does not promise that the Platform will always be available, accurate, secure or free of errors, delays, interruptions, bugs or malicious code.
21.2If a price, Return, balance, fee, credit, trade or other information on the Platform is wrong because of a technical fault, a data error, a human mistake or any other obvious error (a "Manifest Error"), the Company may correct it, cancel or amend any related trade, Return, credit or Withdrawal, and adjust your Account to the position that would have existed without the error. You must repay any amount you received because of a Manifest Error.
21.3The Company may suspend the Platform at any time for maintenance, upgrades, security or any other reason, with or without notice, and is not liable for resulting losses, including missed trading opportunities, positions that cannot be opened or closed, or delayed Withdrawals.
22.Suspension, restriction and termination
22.1The Company may, at any time and at its discretion, with or without notice and without giving reasons where the law allows: suspend, restrict or close your Account; stop or reverse any trade, Return or Withdrawal; terminate a Plan or the Mandate; or end this Agreement. Examples include a suspected or actual breach of this Agreement, fraud, abuse, unlawful activity, a compliance concern, a regulatory or legal requirement, a security risk, inaccurate information, non-payment, or the Company's decision to stop offering a service in your country or generally.
22.2You may end this Agreement by closing your Account in accordance with the Plan Terms and after paying everything you owe. You must first complete any lock-in or notice period and cannot close an Account that has unresolved disputes, open positions, investigations or amounts owing.
22.3On termination the Company will close or transfer open positions as it sees fit, calculate the balance of your Account after fees, losses, costs, taxes and amounts owing, and pay you what remains using the Withdrawal process in this Agreement, subject to verification and to the delays described in it. Returns not yet credited at termination are forfeited unless the Plan Terms say otherwise.
22.4Sections that are intended to continue after termination, including those on risk, fees, liability, indemnity, intellectual property, governing law and disputes, survive termination.
23.Dormant and inactive accounts
23.1If you have not logged in or made any transaction on your Account for the period stated in the Dashboard or Plan Terms, or for twelve months if none is stated, the Company may treat the Account as dormant. It may restrict access, require re-verification, charge a reasonable administration fee if allowed by the Plan Terms or Applicable Law, and stop any Plan or Return that depends on active participation.
23.2The Company will make reasonable efforts to contact you before taking steps that permanently affect your balance. You are responsible for keeping your contact details current. Where Applicable Law requires the Company to transfer dormant balances to an authority, it may do so.
24.Taxes
24.1You are solely responsible for determining, reporting and paying all taxes, duties, levies and charges that arise from your deposits, trades, Returns, profits, Withdrawals and use of the services, in every country where they apply.
24.2The Company does not give tax advice and does not report or withhold tax on your behalf unless Applicable Law requires it. If it must withhold or deduct tax, it may do so and you will not be compensated for it. The Company may report your Account information to tax and other authorities as the law requires.
25.Disclaimers
25.1To the fullest extent permitted by Applicable Law, the Platform, the services, the content and all Returns targets are provided "as is" and "as available", without warranties or conditions of any kind, express, implied or statutory, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, security, profitability or results.
25.2The Company does not warrant that the services will meet your requirements, that any strategy will be profitable, or that any Instrument or market will be available. The Company is not responsible for market movements, including those that cause you loss.
25.3Nothing in this Agreement excludes or limits any warranty, right or liability that cannot be excluded or limited by Applicable Law.
26.Limitation of liability
26.1To the fullest extent permitted by Applicable Law, the Company and its owners, directors, officers, employees, agents, affiliates, contractors and licensors will not be liable to you for any loss, cost, damage or expense of any kind arising from or connected with this Agreement, the Platform or the services, whether in contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise. This includes, without limitation:
- trading losses, loss of capital, failure to make any profit, or Returns that are lower than shown or not paid;
- loss of opportunity, goodwill, reputation, data, or anticipated savings, and any indirect, special, incidental, consequential, punitive or exemplary loss;
- delay, rejection, slippage, re-quotes, stop-outs, margin calls, liquidation or closing of positions;
- anything arising from market volatility, illiquidity, gaps, suspension of trading, or the acts, omissions, insolvency or failure of any Third-Party Provider;
- failures, outages, delays, errors or security breaches of the Platform, the internet, telecommunications, power, payment systems or blockchain networks;
- unauthorised access to your Account resulting from your failure to protect your credentials, devices or email;
- action taken by the Company to comply with Applicable Law or a request from an authority;
- your reliance on any information, projection, illustration or statement not contained in this Agreement.
26.2Where the law does not allow the Company to exclude liability in full, its total aggregate liability to you for all claims connected with the services will not exceed the lower of the amount of fees you paid to the Company in the three months before the event giving rise to the claim and the amount of your Trading Capital affected.
26.3Nothing in this Agreement limits or excludes liability for fraud or fraudulent misrepresentation, for wilful misconduct, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited or excluded.
26.4You agree that these limits are reasonable given the nature of the services, the risks you have accepted and the fees you pay.
27.Indemnity
27.1You agree to indemnify, defend and hold harmless the Company and its owners, directors, officers, employees, agents and affiliates from and against all claims, losses, liabilities, damages, penalties, fines, costs and expenses (including reasonable legal fees) arising from or connected with: your breach of this Agreement or of Applicable Law; any false, inaccurate or misleading information you give; the source or ownership of the funds you deposit; your use or misuse of the Platform; any claim by a person who says you acted for or on behalf of them; your tax liabilities; and any claim that arises from a statement or promise made by you, or by anyone you introduced, to a third party about the Company.
28.Force majeure
28.1The Company is not liable for any failure or delay in performing its obligations that is caused by an event beyond its reasonable control (a "Force Majeure Event"). Force Majeure Events include natural disaster, fire, flood, pandemic, war, terrorism, civil unrest, strike or industrial action, government action, new or changed law or regulation, sanctions, power or internet failure, telecommunications or payment system failure, hacking, cyber-attack, blockchain network failure, fork, congestion or halt, suspension or closure of any market, exchange, bank or broker, and failure or insolvency of a Third-Party Provider.
28.2During a Force Majeure Event the Company may suspend all or part of the services, delay Withdrawals, close or hold positions, change Plan timelines and take any steps it considers appropriate to protect itself and its clients, without liability to you.
29.Intellectual property
29.1All content, text, graphics, logos, trade names, trademarks, software, code, designs, layouts, data compilations and other material on the Platform belong to the Company or its licensors and are protected by copyright, trademark and other laws. Third-party marks belong to their owners.
29.2The Company grants you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use the Platform for your own lawful purposes in accordance with this Agreement. You must not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from any part of the Platform, or use the Company's name or branding, without the Company's prior written consent.
29.3If you send us feedback or suggestions, you give the Company a free, perpetual, worldwide licence to use them for any purpose without credit or payment.
30.Privacy, data protection and recording
30.1The Company processes personal data as explained in the Privacy Policy. By using the Platform you consent to that processing and to the sharing of your data as the Privacy Policy and this Agreement describe, including with Third-Party Providers, regulators and law enforcement.
30.2You agree that the Company may monitor and record emails, chat messages, calls and other communications with you, and may use those records as evidence in any dispute, investigation or proceeding, and for training, quality and compliance purposes.
31.Electronic communications and notices
31.1You agree that the Company may communicate with you electronically, including by posting on the Platform, by email to the address on your Account, by message in the Dashboard, by SMS and by messaging applications, and that these communications satisfy any legal requirement that they be in writing. You are responsible for keeping your contact details current and for checking your email, spam folder and Dashboard regularly.
31.2A notice posted on the Platform is treated as received when it is published. A notice sent by email or message is treated as received twenty-four hours after sending, unless the Company is told it was not delivered.
31.3Notices to the Company must be sent to support@ibfxtech.com or through the contact form on the website, and are treated as received only when the Company actually acknowledges them.
31.4Marketing communications can be turned off using the option in the message or by contacting us. We may still send service, security and legal notices.
32.Complaints
32.1If you have a complaint, please contact support@ibfxtech.com within thirty days of the event, explaining what happened, giving your Account details, and describing the outcome you want. The Company will acknowledge the complaint, investigate it fairly and send you a response within a reasonable time.
32.2If you are not satisfied with the response, you may ask for a review by a more senior member of the Company. Before beginning any formal proceedings you must follow this complaints process in good faith.
32.3Making a complaint does not suspend your obligations under this Agreement, and trades, fees and Returns already processed remain in effect unless and until the Company agrees otherwise in writing.
33.Governing law, disputes and arbitration
33.1This Agreement and any dispute or claim arising out of or connected with it, the Platform or the services, including non-contractual disputes, are governed by the laws of the jurisdiction in which the Company is incorporated.
33.2The parties will first try to settle any dispute through good-faith negotiation for thirty days after one party notifies the other in writing. If that fails, the dispute will be finally settled by arbitration before a single arbitrator appointed under the arbitration laws applicable in the jurisdiction in which the Company is incorporated. The seat of arbitration is the jurisdiction in which the Company is incorporated and the language is English. The arbitrator's award is final and binding and may be enforced in any competent court.
33.3To the extent permitted by Applicable Law, claims may be brought only in your individual capacity and not as a plaintiff or class member in any class, collective or representative action, and you waive any right to a jury trial.
33.4Nothing stops the Company from seeking an urgent injunction or other interim relief in any competent court to protect its rights, systems or property, or to freeze or recover funds.
34.Time limit for claims
34.1To the extent Applicable Law allows, any claim or cause of action you have against the Company arising from or connected with this Agreement or the services must be notified in writing to the Company within twelve months after the event giving rise to it. A claim not notified within that period is waived and barred.
35.General provisions
35.1Entire agreement. This Agreement is the entire agreement between you and the Company about its subject matter and replaces all earlier statements, promises, representations, proposals and understandings, whether written or oral.
35.2Severability. If any provision of this Agreement is found to be invalid, illegal or unenforceable, it will be limited to the minimum extent necessary or removed, and the rest of the Agreement will continue in full force.
35.3No waiver. A failure or delay by the Company in exercising a right is not a waiver of it. A waiver is effective only if it is in writing and signed or confirmed by the Company.
35.4Assignment. You may not assign, transfer or encumber any of your rights or obligations under this Agreement without the Company's written consent. The Company may assign, transfer or subcontract any of its rights or obligations to any person at any time and you consent to this.
35.5No partnership or agency. Except for the agency created by the Mandate, nothing in this Agreement creates a partnership, joint venture, employment or fiduciary relationship between you and the Company.
35.6Third parties. Only you and the Company have rights under this Agreement, except that the Company's affiliates and personnel may rely on and enforce the provisions that protect them.
35.7Language. This Agreement is made in English. Any translation is for convenience only and the English version prevails.
35.8Set-off. The Company may set off any amount you owe it against any amount it owes you, in any currency or asset and across any of your Accounts.
35.9Death or incapacity. If you die or lose legal capacity, your Account may be frozen until the Company receives documents it considers sufficient to prove the entitlement of your legal representative, and the Mandate may continue until then.
36.Changes to these Terms
36.1The Company may update these Terms, the Risk Disclosure, the Privacy Policy, any Plan Terms and any fee, at any time by publishing the new version on the Platform or by notifying you in the Dashboard or by email. Unless a later date is stated, the change takes effect on publication.
36.2Your continued use of the Platform, or of any Plan, after a change takes effect means you accept it. If you do not accept a change, you must stop using the services and close your Account in accordance with this Agreement. Changes will not affect a trade already made or a right that has already arisen.
36.3You should read these Terms regularly. The date at the top of this page shows when they were last updated.
37.Contact
37.1Questions about these Terms can be sent to support@ibfxtech.com or through the contact page. Please keep a copy of these Terms for your records.
